2 November 1942 Civil handling of motor vehicle accidents on the islands

Fifteenth Army Headquarters, Senior Quartermaster / Qu 1. Army headquarters, 2 November 1942. For official use only.
Special Instructions for Supply and for the Supply Troops No. 50.
IV. Motor transport matters.
8. Accident processing: handling under civil law of motor vehicle accidents in occupied French territory. Army Motor Transport Officer.
To simplify the handling of motor vehicle accidents under civil law, the administrative director in Military Administrative District A has announced the following:
a) Observance of jurisdiction.
This office is responsible for the handling under civil law of motor vehicle accidents occurring on the English Channel Islands and in the following French departments:
Seine-et-Oise; Seine-et-Marne; Calvados; Manche; Oise; Aisne; Somme; Ardennes; Cher; Eure; Loir-et-Cher; Orne; Seine-Inférieure; Loiret; Eure-et-Loir.
Elsewhere in France, jurisdiction is as follows:
For the Seine department, Paris: the Commandant of Greater Paris, Paris.
For the departments of Pas-de-Calais and Nord: the Military Commander in Belgium and Northern France.
For the remaining departments in western and south-western France: the head of Military Administrative District B, Angers.
For the remaining departments in south-eastern France: the head of Military Administrative District C, Dijon.
b) Observance of the Army High Command decree of 18 April 1942, published in the Army Ordinance Bulletin 1942, Part B, No. 99 [numeral faint].
Under this decree, in cases of minor negligence where there is no third-party damage, the Reich’s claim for recourse may be waived by the driver’s disciplinary superior. The accident files must then be sent to the competent administrative office for safekeeping; in France, this is the senior administrative director attached to the Military Commander in France, Paris.
c) Include in the accident report a brief note estimating the property damage, including that of the other party where appropriate, and, if possible, state where the vehicle concerned is being repaired.
d) Include in the accident report a brief note on the type of medical treatment received by injured Wehrmacht or SS personnel, for example:
aa) Two injured men: SS rifleman Müller and SS rifleman Friedrich. Hospital treatment was necessary for both.
bb) Four slightly injured men: hospital treatment was not necessary.
e) Include a note in the accident report stating whether the accident was formally recorded by the military police or the French police.
The above amendments under a–e, together with Section V/3 in accordance with Army Notices 1942, paragraph 706, are to be entered in Fifteenth Army Headquarters’ “Instruction sheet for processing motor vehicle accidents”.
[Authentication at the end of the order:] For Army Headquarters: the Senior Quartermaster, signed Gittner. Certified correct: [signature unclear], Major, General Staff.

Editorial note: Complete item IV 8, continuing over three original pages. Unrelated items in this omnibus supply order are excluded. “English Channel Islands” is the original wording; it refers to the Channel Islands.
